Terms of Sale

These Terms of Sale (Terms) define the relationship between the Contributor and the Operator of the e-shop Real Gift which occurs during a sale. During the process of placing an order the Contributor is required to tick a box whereby he/she confirms that he/she understands and agrees with the Terms.

I. Introductory Provisions

The Operator

People in Need, a registered charity (no 25755277), based in Šafaříkova 24, 120 00 Prague 2, the Czech Republic, is a charity providing humanitarian and development assistance and is registered at the City Court in Prague under Section O, File no 119.

In accordance with the Act No 117/2001 Coll., on Public Collections and on Amendment of Certain Related Acts (Public Collection Act), the Operator runs a public collection under the name of 'Real Help' (hereinafter referred to as Public Collection), announced to the Municipality of the city Prague under the File No S-MHMP/204638/2011, in order to obtain financial resources to fund the promotion and implementation of development cooperation projects in line with the Millennium UN MDGs, particularly in the sectors of education, livelihoods, water and sanitation, health and fighting poverty in countries agreed by the Ministry of Foreign Affairs of the Czech Republic, and also to enable the organization to develop, particularly by creating a strong and stable base for implementing the projects listed above and the associated costs.

The operator operates an e-shop "Real Gift" (hereinafter referred to as 'e-shop') which enables members of the public to contribute to the Public Collection by purchasing a Gift Certificate.

The Contributor

The Contributor contributes to the Public Collection by purchasing a Gift Certificate through the e-shop. The contribution to the Public Collection is the value of the certificate offered by the e-shop. Depending on the Contributor’s choice he/she contributes to one of the four main aid projects: WATER, SCHOOLS, LIVELIHOODS, HEALTH.

During the placement of an order the Contributor gives the Operator their consent to use their personal details for the purpose of processing their order and for the purpose of issuing a confirmation of a gift purchase, should the contributor require; Article VI of the Terms deals with personal data protection.

The relations between the Contributor and the Operator which are not expressly modified under the Terms are subject to Act No.17/2001 Sb., on Public Collections, as amended by later regulations and Act No 40/1964 Sb., Coll. Civil Code, as amended. The Contributor is aware that the Operator is neither a supplier as defined in § 52 paragraph 2 of the Civil Code, nor an entrepreneur as defined in § 612 of the Civil Code.

II. The Terms of Ordering and Supplying a Gift Certificate

A Gift Certificate can be ordered through the e-shop whereby the Contributor places a chosen certificate into a basket with the option of writing a personal message to the person to whom he/she chooses to send the gift. Within the order the Contributor is required to enter their personal details needed to process their order and to issue a confirmation of a gift purchase should the Contributor require one. The confirmation is issued to the Contributor with every order placed.

The Contributor can pay only by credit/debit card. The contributor will be charged a fee of 3.3% in addition to the total value of their order. The Contributor can choose to pay in the following currencies: EUR, USD, GBP, CZK.

Following a successful payment a certificate is generated in PDF format which is saved on a server of the Operator. Depending on the option that the Contributor selected during the placement of the order the purchased certificate is sent either immediately or at later date. The gift recipient receives the Gift Certificate as a PDF attachment.

III. A confirmation of a gift purchase

The Contributor can ask for a confirmation of a gift purchase by ticking the appropriate box. In this case the Operator will email the confirmation to the Contributor in a PDF format in the Czech and English versions.

The confirmation of a gift purchase is a document required by the Czech Inland Revenue for tax relief purposes. During the placement of the order the Contributor has to enter their permanent address in order to be identified in the confirmation as the purchaser of the gift certificate. The value of a gift in the confirmation will be recorded as the value of a purchased gift certificate. The date of the gift purchase will be recorded as the date when the Operator received the payment at its bank account or in cash.

The Contributor can ask for a confirmation of a gift purchase retrospectively providing that a proof of purchase via the e-shop is supplied. Proof of purchased is considered to be the Contributor’s personal details and a purchase order number sent to the Contributor in the order confirmation email.

IV. Claims and Complaints

Operator deals with complaints regarding the type or the number of supplied certificates, their design, late delivery or a failure to deliver. The Operator is responsible for any defects in certificates at the time of their shipment. Due to the nature of Public Collection the certificates are not subject to warranty or to other conditions specified in § 612 of the Civil Code.

The Contributor should notify the Operator immediately of any claims and complaints via email at: . The email must include the date and the number of the order which was sent to the Contributor in an order confirmation email.

In the event of the Contributor entering a wrong email address he/she can ask the Operator to re-send the electronic certificate to a new address and the Operator endeavors to re-send the certificate. Any mistakes made by the Contributor in their personal message to the gift recipient cannot be corrected. If the gift recipient does not receive the gift certificate by a set date the Contributor can ask the Operator to re-send the certificate

V. Personal Data Protection

The Operator is obliged to deal with personal data of the Contributor in accordance with Act No 101/2000 Sb., Personal Data Protection, as amended by later regulations. All personal and business information provided by the Contributor at the time of the purchase via e-shop is confidential.

The contributor enters their personal details for the purpose of processing the order including their permanent address for the purpose of issuing a confirmation of a gift purchase. The Operator is obliged to use this information only for the purpose of processing the order and only for the necessary period of time. Personal details can be disclosed to a third party, specifically the gift recipient's name and address to a delivery company and the Contributor’s name and details of their order to a bank for the purpose of processing payment using MasterCard and VISA cards on Internet.

The Contributor can provide the Operator with their consent to process their personal details for the purpose of receiving the latest information about People in Need’s projects and for the purpose of maintaining an ongoing relationship with the donor. In this case the Operator is obliged to use the data only for the purpose defined by the Contributor and as necessary within the definition of the Data Protection Act, until The Contributor advises the Operator otherwise. The Contributor should advise the Operator of any changes they wish to make in this matter in writing to the Operator’s central office address or by sending an email to .

The Contributor has the right to access their personal data held by the Operator, especially information about processing their personal details (§ 12 of the Persona Data Protection Act), and the right to correct their personal details. The Contributor has the right to demand explanation in the event of unlawful processing of their personal details, immediate rectification and the right to complain to the Data Protection Office (§ 12 of the Persona Data Protection Act).

VI. Closing Provisions

All transactions between the Contributor and the Operator arising from all purchases made via e-shop including any disputes thereof are subject to the law of the Czech Republic. All disputes concerning purchases made via e-shop will be dealt with by the courts of the Czech Republic.

The Terms of Sale and its changes come into effect on the date of its publication on the website www.real-gift.org. The most recent changes of the Terms came into effect on 1st November 2011
